Reactie Boeing op uitspraak WTO over belastingvoordelen van de staat Washington

Amsterdam, 28 november 2016 – De Wereldhandelsorganisatie (WTO) wees vandaag praktisch alle bezwaren af die de Europese Unie maakte tegen belastingvoordelen in de Amerikaanse staat Washington.

 

 

 

 

 

In de zaak die vandaag werd behandeld, tekende de EU bezwaar aan tegen zeven verschillende belastingvoordelen. Daarvan wees de WTO er zes volledig af, en verwierp het de zevende grotendeels. De WTO kende alleen het bezwaar toe dat een korting op de Business and Occupancy-staatsbelasting in Washington voor toekomstige 777X-omzetten niet in lijn is met WTO-overeenkomsten. De WTO verwierp verder alle bezwaren die de EU indiende tegen verschillende voordelen en tornde zelfs niet aan het B&O-belastingtarief omdat dit van toepassing is op omzet van andere in de staat Washington geproduceerde modellen: de 737, 747, 767, 777 (huidig model) en 787.

De EU stelde dat Boeing in totaal 8,7 miljard Amerikaanse dollar aan subsidies ontving. Dit werd afgewezen door de WTO, dat slechts 50 miljoen dollar aan toekomstige belastingvoordelen ontoelaatbaar vindt. De WTO concludeerde dat Boeing tot dusver geen voordeel heeft behaald uit het 777X-tariefvoordeel, en dat voor 2020 ook niet zal doen omdat het eerste vliegtuig niet eerder wordt afgeleverd.

“De beslissing die vandaag is genomen is een overwinning voor de Verenigde Staten, de staat Washington en voor Boeing”, zegt J. Michael Luttig, algemeen juridisch adviseur van Boeing. “De WTO oordeelde in september dat Airbus 22 miljard Amerikaanse dollar aan illegale subsidies ontving van de EU, en dat Airbus noch zijn vliegtuigen zonder die subsidies vandaag nog zouden bestaan. Door het verwerpen van praktisch alle bezwaren die de EU maakte in deze zaak, oordeelde de WTO vandaag dat Boeing daarentegen geen cent aan ontoelaatbare subsidies heeft ontvangen.”

“De WTO heeft meerdere malen geconcludeerd dat Airbus volledig bestaat uit gratie van de overheid, en dat het bedrijf ervoor moet zorgen dat het de internationale wetten nakomt omdat het anders enorme boetes riskeert”, zegt Luttig.

In het licht van de beslissing van vandaag, en het feit dat de WTO een enorme verantwoordelijkheid neerlegt bij de EU en Airbus, is het onze verwachting dat de EU en Airbus in beroep zullen gaan. Luttig: “We gaan er volledig vanuit dat Boeing na beroep elk aspect van de belastingvoordelen van de staat Washington behoudt, inclusief het 777X-omzetbelastingtarief.”

CHICAGO, Nov. 28, 2016 /PRNewswire/ — The World Trade Organization (WTO) today rejected virtually all of the European Union’s challenges to the Washington state tax incentives.

In today’s case, the EU challenged seven different state tax incentives.  The WTO rejected entirely the EU’s challenge to six of the seven incentives and rejected most of the challenge to the seventh.  The WTO held only and narrowly that a reduction in Washington state’s Business and Occupancy (B&O) tax rate for future 777X revenues is inconsistent with the WTO agreements.  The WTO threw out all of the EU’s other challenges to various incentive programs and left untouched even the B&O tax rate as it applies to revenue from the other Boeing models produced in Washington state–the 737, 747, 767, 777 (current model) and 787.

In total, the EU claimed that Boeing had received $8.7 billion in subsidies.  This claim was rejected by the WTO, which found future incentives totaling no more than $50 million a year to be impermissible.  The WTO found that to date Boeing has received no benefit from the 777X rate incentive, and will not until 2020, because the first airplane will not be delivered until then.

“Today’s decision is a complete victory for the United States, Washington State and Boeing,” said J. Michael Luttig, Boeing’s general counsel.  “The WTO found in September that Airbus has received $22 billion in illegal subsidies from the EU and that without these subsidies neither Airbus itself nor any of its airplanes would even exist today.  By contrast, in rejecting virtually every claim made by the EU in this case, the WTO found today that Boeing has not received a penny of impermissible subsidies.”

“The WTO has repeatedly found that Airbus is entirely a creature of government, and they must now bring themselves into compliance with the international laws or risk massive sanctions,” said Luttig.

In light of today’s decision and the massive liability that the WTO has found against the EU and Airbus, we expect the EU and Airbus to appeal today’s decision.  “After any appeal,” Luttig said, “we fully expect Boeing to preserve every aspect of the Washington state incentives, including the 777X revenue tax rate.”
